1. Scope and Acceptance
These Terms govern your use of the SparkRoute mobile app, provided by Jan Metzger, Alter Turnplatz 2, 75181 Pforzheim, Germany ("we", "us"). By installing or using the app, you accept these Terms. If you do not accept them, please discontinue use.

2. The Service
SparkRoute helps drivers of electric vehicles plan routes and find charging stations along the way. The app is provided free of charge. We may change, restrict or discontinue features at any time; we will not do so arbitrarily and will give notice of significant changes where reasonable.

3. Navigation Is an Aid, Not an Instruction
SparkRoute is a planning and navigation aid providing information only. It does not relieve you of responsibility for driving.

You must always observe road traffic regulations, road signs, signals and actual road conditions, all of which take precedence over anything the app displays. Do not operate the app while driving. Route suggestions, estimated ranges, charging times, station locations, availability and power ratings may be incomplete, outdated or incorrect — do not rely on them where doing so could endanger anyone or leave you stranded.

Range and consumption figures are estimates based on generic vehicle data and cannot account for your actual driving style, load, weather, terrain or battery condition.

4. User Accounts
An account is optional. If you create one:
• you must provide a valid email address and keep your password confidential;
• you are responsible for activity carried out through your account;
• you must be at least 16 years old;
• you may not use another person's account or share yours.

You may delete your account at any time in the app or through our web portal. We may suspend or terminate an account that is used unlawfully, that attacks or overloads our systems, or that repeatedly breaches these Terms. Where we do so, we will inform you unless legally prevented.

5. Acceptable Use
You agree not to interfere with the app or our servers, not to attempt unauthorised access, not to place automated or excessive load on our interfaces or those of the third-party providers we rely on, and not to reverse engineer the app except to the extent permitted by mandatory law.

6. Third-Party Data and Services
The app displays data from third parties, in particular routing and address data from TomTom, charging station data from the Open Charge Map community, map data from OpenStreetMap contributors, amenity data via the Overpass API, and vehicle data from Open EV Data. We do not create this data and are not responsible for its accuracy, completeness or availability. Attributions and licences are listed under Open Source Licenses in the app.

Charging, payment and access at a charging station are governed by the operator of that station, not by us. We are not a party to that relationship.

7. Rights in the App
The app and its content remain our property or that of our licensors. You receive a simple, non-exclusive, non-transferable right to use the app on your devices for its intended purpose. Open source components are governed by their own licences, which take precedence for those components.

8. Warranty
The app is provided free of charge. Statutory warranty rights for gratuitous provision under German law remain unaffected. We do not warrant that the app will be uninterrupted or error-free, nor that third-party data displayed in it is accurate or available.

9. Liability
We are liable without limitation for damages arising from injury to life, body or health, for damages caused intentionally or by gross negligence, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have assumed a guarantee.

In cases of slight negligence, we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the agreement possible in the first place and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage foreseeable and typical for this type of agreement.

Any further liability is excluded.

10. Changes to These Terms
We may amend these Terms where necessary, for example because of changes to the app, to the providers we rely on, or to the law. We will announce material changes in the app before they take effect. If you do not agree to them, you may stop using the app and delete your account.

11. Governing Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.

12. Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected.
